# US-Canada Cross-Border Operations

Canada has different regulatory frameworks than the US. Most provinces issue their own commercial operating authority, separate from federal regulations. This skill walks through what changes when a US carrier hauls into Canada or a Canadian carrier hauls into the US.

## Canadian regulatory landscape

Unlike US (which has federal FMCSA), Canada's commercial vehicle regulation is **provincial**, coordinated by Transport Canada under the National Safety Code (NSC):

A US carrier hauling into Canada often must register in each province operated. Most use the **NSC-14 Carrier Profile** as the federal-equivalent identifier.

## US Carrier Obtaining Canadian Authority

For long-haul operations into Canada:

1. **Apply for Canada-specific carrier authority** — either Federal NSC or province-by-province
2. **Vehicle registration** — typically through IRP (most provinces participate)
3. **Fuel tax** — IFTA-equivalent or per-province
4. **Insurance** — US BMC-91 doesn't satisfy Canadian requirements; need Canadian liability filings
5. **Drug & alcohol program** — Transport Canada has its own program; US 49 CFR 382 + 40 program acceptable

## Canadian Driver Requirements

### Drivers entering Canada (US-domiciled)

- Valid US CDL
- Valid US DOT medical card (Canadian medical card not required)
- Valid US passport OR Enhanced Driver License (EDL — some states)
- **FAST card** (recommended; expedited entry)
- US Operating authority paperwork

Canada does NOT require a separate driver work visa for short-term CMV operations from US.

### Drivers entering US from Canada

- Valid Canadian commercial license (province-specific)
- Canadian medical card
- Passport or NEXUS card
- Some operations require US-style ELD compliance for the US portion

## CBSA (Canada Border Services Agency)

When crossing into Canada:

1. **ACI (Advance Commercial Information)** — pre-arrival manifest filed electronically
2. **Driver presents** passport + ACI confirmation + carrier credentials
3. **Customs assessment** — duties for non-USMCA goods, taxes for some categories
4. **eManifest** — Canadian electronic system

## NSC vs US compliance

Note: **Canadian HOS allows 13-hour driving**, not 11 like the US.

## Province-Specific Quirks

### Ontario
- CVOR is the foundational ID. Required for all commercial operations in Ontario.
- CVOR Carrier Score System (similar to FMCSA's CSA). Drivers + carriers tracked.
- Cost: ~$200 to register; annual fee ~$60.

### Quebec
- French-language requirements for some documents
- Quebec-specific Heavy Vehicle Operator (HVO) certificate
- Distinct fuel tax administration

### BC
- Provincial Commercial Vehicle Safety Enforcement (PCVSE)
- Specific weight + dimension rules
- Coastal route restrictions

### Alberta
- Transport License Plate (TLP) for visiting carriers
- Annual Safety Fitness Certificate
- Strong oil/gas industry compliance overlay

## Health Canada Hazmat

Transport of dangerous goods in Canada follows the **Transportation of Dangerous Goods (TDG) Regulations** under Transport Canada, separate from US 49 CFR 171-180.

US carriers carrying hazmat into Canada must:
- Comply with TDG regulations
- Include Canadian-language hazmat labels (English + French in Quebec)
- Have Canadian-trained employees (TDG training accepted)
- Carry Mexico/Canada-specific emergency contact numbers

Hazmat classification may differ slightly between US 49 CFR + Canadian TDG; verify each shipment.

## Insurance for Canada

- US BMC-91 / BMC-91X does NOT satisfy Canadian liability requirements
- Need Canadian-specific liability filings (often via Canadian-licensed insurer)
- Some US insurers offer Canada endorsements
- Minimum liability typically C$1,000,000 - C$5,000,000 (province-specific)

## Common Canadian Cross-Border Mistakes

1. **US carrier crosses into Canada with US insurance only.** Canadian authorities may flag at border; civil + criminal exposure.
2. **Driver not knowing Canadian HOS rules apply.** Drive past Canadian 13-hour limit because used to US 11-hour.
3. **Hazmat without Canadian-language labels.** TDG violation; cargo refused at border.
4. **No CVOR registration when operating in Ontario.** Operating illegally.
5. **Operating across Canadian provinces** without each province's required permits.
6. **Forgetting eManifest pre-arrival declaration.** Cargo refused or extensive delay.

- $50 every 5 years
- Background check + interview
- Expedited entry processing
- Required documents kept simpler
